1. Agreement to Terms
Welcome to MyChom. These Terms of Service ("Terms") constitute a legally binding agreement between you and MyChom ("we," "us," or "our") governing your access to and use of the MyChom mobile applications, including the MyChom Trainer app and the MyChom client app, as well as this website and any related services (collectively, the "Services").
By creating an account, downloading the app, or otherwise using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use our Services.
2. Eligibility
You must be at least 18 years of age to use MyChom. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
If you are using MyChom on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
3. Account Types
3.1 Trainer Accounts
The MyChom Trainer app is designed for professional personal trainers. By registering as a trainer, you represent that you are a qualified fitness professional and take full responsibility for the training programmes, advice, and guidance you provide to your clients through the platform.
Trainer accounts require an active subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Client Accounts
The MyChom app is designed for clients working with personal trainers. Client accounts are linked to a trainer through an invitation process. You are responsible for ensuring the accuracy of any information you provide and for your own fitness decisions.
3.3 Account Security
You agree to immediately notify us at support@mychom.app if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
MyChom supports biometric authentication (Face ID, Touch ID, fingerprint) as a convenience feature. This biometric data is processed entirely on your device and is never transmitted to or stored by MyChom.
4. Subscriptions & Payments
4.1 Trainer Subscription
Access to the MyChom Trainer app requires an annual subscription. Subscription fees are charged in advance for each subscription period. All fees are stated in your local currency and are inclusive of any applicable taxes unless otherwise stated.
4.2 Billing & Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Renewal charges will be applied to your payment method on file. We will notify you before your subscription renews.
4.3 Cancellation
You may cancel your trainer subscription at any time through your account settings or the relevant app store (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. We do not provide pro-rata refunds for unused portions of a subscription period, except where required by applicable law.
4.4 Price Changes
We reserve the right to modify subscription pricing. We will provide at least 30 days' written notice before any price change takes effect. Your continued use of the Services after the effective date of a price change constitutes acceptance of the new price.
4.5 Free Trials
We may offer free trial periods from time to time. If you do not cancel before the trial period ends, you will be charged the applicable subscription fee. Trial eligibility is determined at our sole discretion.
5. Client Invoicing
MyChom provides trainers with tools to generate, send, and track invoices for their clients. Payments made between trainers and clients are transactions between those parties directly. MyChom is not a party to any payment transaction between trainers and clients and accepts no responsibility for the collection or processing of such payments.
Trainers are solely responsible for ensuring the accuracy of invoices issued through the platform and for complying with all applicable tax and financial regulations in their jurisdiction. MyChom's PDF invoice generation feature is provided as a convenience tool only.
6. Health Data & Fitness Information
6.1 Not Medical Advice
MyChom is not a medical service and does not provide medical advice. All content, data, workout plans, and communications on our platform are for general fitness and informational purposes only. Nothing on MyChom constitutes or should be construed as medical advice, diagnosis, or treatment.
Always consult a qualified healthcare professional before starting any new exercise programme, particularly if you have a pre-existing medical condition, injury, or health concern.
6.2 Health Platform Integrations
MyChom may integrate with Apple Health (HealthKit) and Google Health Connect to read health and fitness data such as step counts, heart rate, calories burned, body weight, sleep data, and exercise records. This integration is optional and requires your explicit permission.
Your health data is used solely to enhance your experience within MyChom and is never sold to third parties. See our Privacy Policy for full details on how health data is handled.
6.3 Accuracy of Data
Health metrics displayed in MyChom are sourced from your device's health platform and connected sensors. We make no warranties as to the accuracy, completeness, or reliability of any health data displayed in the app.
7. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Impersonate any person or entity, or misrepresent your qualifications as a trainer
- Upload or transmit content that is harmful, abusive, defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorised access to any part of the Services or another user's account
- Introduce viruses, malware, or any other harmful code
- Scrape, crawl, or otherwise extract data from our Services by automated means
- Use the Services for any commercial purpose not expressly permitted by these Terms
- Harass, threaten, or intimidate other users
We reserve the right to suspend or terminate accounts that violate these standards.
8. Intellectual Property
8.1 Our Content
MyChom and all content, features, and functionality of the Services — including but not limited to text, graphics, logos, icons, and software — are owned by or licensed to MyChom and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8.2 Your Content
You retain ownership of any content you submit to the Services, including session notes, client data, and progress records. By submitting content, you grant MyChom a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the Services to you.
8.3 Feedback
If you submit feedback, suggestions, or ideas about the Services, you grant us an unrestricted, royalty-free right to use that feedback for any purpose without any obligation to you.
9. Third-Party Services
MyChom uses third-party services to power certain features, including but not limited to:
- Supabase — for authentication and database services
- Apple HealthKit / Google Health Connect — for health data integration
- Firebase Cloud Messaging — for push notifications
- Apple App Store / Google Play Store — for app distribution and subscription billing
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
10. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MYCHOM DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content or data within the Services.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYCHOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO MYCHOM IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless MyChom and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Services
- Your breach of these Terms
- Any training advice or services you provide to clients through the platform (for trainers)
- Your violation of any third-party rights
13. Termination
You may delete your account at any time through the app settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if required by law. Trainer subscriptions cancelled due to a Terms violation are not eligible for a refund.
Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
14. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the app, email, or by posting a notice on our website, and we will update the "Last updated" date at the top of this page. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree with the revised Terms, you should stop using the Services and may cancel your account.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MyChom is incorporated, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
